A statewide ESAS search for cases involving the same statute (F.S. ยง 794.04(1)), the same offense level (6) and the same amount of CPC sentencing points (36) shows a sentencing range from 30 days in county jail to 11 years in state prison. All defendants had no prior criminal convictions.
