Where Are Certificate of Need Laws in Place?

Thirty-five states and Washington, D.C., still have “certificate of need,” or CON, laws intended to prevent unfettered health care expansion. But some economists, lawmakers, and health care providers have pushed back against the laws, partly because the appeals process can stall hospital construction or delay medical equipment even where states have documented their need.
