16 states and D.C. already have laws protecting the right to an abortion post-Roe

States, plus the District of Columbia, that have codified abortion protections as of May 3, 2022.

Abortions pre-viability are legal in California, Nevada, Washington, Hawaii, Illinois, Maryland, New York, Rhode Island, Massachusetts, Connecticut, Maine and Delaware. Abortions are legal throughout a pregnancy in Oregon, Colorado, New Jersey, Vermont and the District of Columbia.

Viability is defined as when a fetus can survive outside of the womb; this measure varies by each pregnancy but is usually met around 24-28 weeks.
