What states allow possession of drug checking equipment like test strips?
All but six states have removed language from laws that classify drug checking equipment (or DCE) for fentanyl as paraphernalia. Legislation in Indiana to follow suit failed during its 2024 legislative session.
A map that shows states in yellow if it has decriminalized the possession of drug checking equipment, orange if it has made an exception for fentanyl, and red if drug checking equipment is criminalized. Six states are in red: Idaho, North Dakota, Texas, Illinois, Indiana and Iowa. Illinois is weird because equipment to test if drugs have been altered is legal as of Jan. 1, 2024.
Some states, like California and Kansas, have broader exceptions to their DCE laws for synthetic opioids, ketamine and gamma
hydroxybutyric acid (or GHB, sometimes simply referred to as G).
