Estimate of the Share of the Workforce with a Paid Family or Medical Leave Claim (January 2026)

Date ranges for states vary based on available program data. All types of leave claims permitted by a program are included in this calculation. Percentages are approximate because of difficulties determining the exact size of the eligible workforce everywhere except New York, where the number of eligible workers is provided.

Calculations use the number public program claims divided by the number of employed persons in the civilian or private sector labor force, as appropriate, at the midpoint of the date range for the relevant program data. In some cases, a worker may submit more than one claim. Utilization is only captured for workers whose claims were filed in each state's public program. Because some states permit employers to privately insure workers for TDI, PFL or both, actual utilization may higher, but are very unlikely to be higher than Rhode Island, where TDI is long-established, the workforce is older, and all workers are in the public program.
