Hurst Resentencing Outcomes Before and After Florida's 2023 Nonunanimous Jury Law

The Supreme Court's 2016 decision in Hurst v. Florida resulted in death sentences being vacated for 145 people on Florida's death row. Their resentencing hearings required jurors to unanimously vote for death—that is, until a new state law signed April 20, 2023 authorized a jury to impose death with just eight votes.

Last updated: 1/8/2026. Note: Some of the cases that ended in life did not face a jury, as the state waived the death penalty. Two death sentences after 4/20/23 did not use the 8-4 standard; one case used the unanimous standard and the other defendant waived a jury. This chart captures 119 cases resolved legally; six individuals died on death row, and 20 cases remain pending.
