Figure 2: Which States Have Considered Banning Data Centers in 2026?   

This map presents data on state legislative bills introduced after January 1, 2026. To clarify, this map focuses on banning data centers themselves, and not banning data center tax incentives.

Note: No state has thus far enacted legislation that imposes an moratorium specifically targeting data center projects. NH H.B. 1265 (2026) was an introduced state legislative bill identified by Multistate that does not appear in the Quorum search but was included in this figure. ME L.D. 307 / H.P. 207 (2026) was an introduced state legislative bill identified by LegiScan that does not appear in the Quorum search but was included in this figure.  While the data center ban in New York state was enacted via NY Executive Order 62 (2026) from Governor Kathy Hochul and not from an enacted state legislative bill, it has been included due to its relevance to the issue. The following Quorum search parameters were used to generate these results:
