Abortion banned in some states, protected in others

According to a New York Times analysis of state laws, as of Jan. 6, 2026, abortions are banned in 13 states.

Abortions are fully legal or restricted at a point of fetal viability or 22 to 24 weeks of gestation in the District of Columbia and 30 states, nine of which have enacted new protections since the beginning of 2024.

Seven states have bans based on how long a person has been pregnant. Four ban abortions after six weeks of pregnancy, two after 12 weeks of pregnancy and one after 18 weeks.
