Minnesota saw more habeas cases filed per capita than almost any other state in 2026

Since the beginning of the year, there have been more habeas petitions filed in Minnesota relative to its population than any other state except New Mexico. That translates to over 17 habeas cases for every 100,000 Minnesotans between Jan. 1, 2026 and Feb. 22, 2026. 

Habeas suit counts include civil suits with Nature of Suit Codes: 463 - Habeas Corpus (Alien Detainee); 530 - Habeas Corpus (General); 535 - Habeas Corpus (Death Penalty); 555 - Habeas Corpus (Prison Condition)
