How vacancies are filled in state supreme courts

Notes: State Senate confirmation required in HI, NY, VT, ME, MT, NJ, PA, and TX. Confirmation from both legislative chambers required in TN and RI. Executive Council and Governor's Council approval required in NH and MA, respectively. In LA, the supreme court may appoint a temporary judge until the special election, and the appointee may not run in the election. In VA, the governor may appoint a temporary judge if the legislature is not in session. In ND, the governor has the option to call a special election instead of appointing a judge.
